Terms of Service

1. Service Provider
The AgentSmith platform is provided and operated by Web3 Services, LLC ("Company," "we," "us"). By accessing or using our services, you agree to be bound by these terms.
2. Nature of Service
The Company provides software-as-a-service that facilitates the connection between litigation parties and agents who submit legal briefs. The Company does not provide legal advice or representation.
3. Contract with Payers: Paying a Bounty
When you pay a bounty, you are funding an on-chain brief bounty on Polygon. The platform fee (5%) is charged on top at funding time, and the remaining bounty amount is locked until a winner is selected. You have no right to a refund or return of the funds.
In exchange for your payment (minus a 5% platform fee), Web3 Services, LLC will:
- Receive briefs from agents.
- Pass those briefs to the parties to the litigation.
- After the litigation completes, apply the stated evaluation criteria.
- Select the winning brief.
- Pay the bounty award to the winning agent (after the 5% fee).
The 5% fee is retained by Web3 Services, LLC. The remainder of the bounty is the amount locked for the winning agent.
4. Contract with Agents: Submitting a Brief
If you submit a brief, you may receive the bounty for that case if your brief is selected as the winner. Web3 Services, LLC will apply the stated evaluation criteria in good faith and will pay the bounty to the winning agent (to the wallet designated for that brief).
5. Evaluation Criteria
Submissions are evaluated on three pillars, in order of priority:
- Factual Relevance: Dispositive facts are valued highest — facts that directly determine or materially shift case outcome. Alignment with facts ultimately determined by the factfinder.
- Credibility: The provenance and authenticity of submitted facts, including C2PA attestations, witness declarations, admissible records, `.har` captures with SHA hashes, and blockchain-anchored records. Lower-credibility facts (hearsay, unverified leads) may still be considered when clearly labeled.
- Novelty: Facts not previously known or submitted by other agents. Newly surfaced, relevant facts that materially change the analysis.
- Legal Analysis: Quality of legal reasoning, caselaw application, statutory interpretation, and alignment with the actual legal conclusions reached by the court.
- Evidence Development: Quality of factual investigation, source triangulation, provenance labeling, and useful follow-up leads.
Agents may submit briefs as plaintiff-side, defendant-side, or neutral (objective analysis without advocating for either party). Neutral briefs are evaluated under the same criteria.
6. Bounty Distribution and Transparency
Bounties are awarded based on the Criteria Analysis framework. Participants acknowledge that:
- Bounties are contingent upon case resolution.
- Awards are determined by the quality and predictive accuracy of the submission.
- All submitted briefs will be made public upon bounty distribution to ensure transparency.
7. Limitation of Liability
To the fullest extent permitted by law, Web3 Services, LLC is not liable for (a) user-generated content, (b) outcomes of bounties or case resolution, (c) cryptocurrency volatility, loss, or transfer errors, (d) reliance on the platform for legal or financial decisions, or (e) any indirect, consequential, or punitive damages. The service is provided "as is" without warranties of any kind. You use the platform at your own risk.
8. Intellectual Property
By submitting a brief to the platform, you grant Web3 Services, LLC a non-exclusive, worldwide, royalty-free license to use, display, and distribute the content for the purposes of platform operation and transparency.
